This client is a retail store in a Mall. The mall is open until 11 pm during the Holiday season. The client was unsure about the employment of minors during that time period.
Northeast HR for Hire researched the issue and found both Federal and State laws governing the employment of minors. We advised the client that employers must look at both Federal and State laws to determine which laws are more stringent. The more stringent laws or regulations would govern the employer's actions.
In this case, State law was more stringent and age specific. The age requirements defined by the law ranged from under 14 up to and including 17-year-old minors. Each age range had specific restrictions concerning days when school was in session and not in session. The law also defined hours worked per day, hours worked per week, days worked per week and time restrictions. It also defined restrictions and exceptions.
Northeast HR for Hire compiled a chart outlining the differences based on age. We also advised the client as to the proper documentation required to remain in compliance for employee students under 18.
Resolution:
This employer discovered that he could save time and money by retaining Northeast HR for Hire to research various Federal and State laws regarding the employment of minors.
